O processo para a solicitação do Visto H2A é semelhante a outros pedidos de visto de trabalho para não imigrantes. Este é o passo a passo a ser seguido pelo trabalhador estrangeiro:

 

Preenchimento do Formulário DS-160: Este é o formulário padrão para um pedido de visto de não imigrantes que autoriza a entrada temporária nos Estados Unidos. O formulário DS-160 está disponível no site do Consulado americano. É preciso pagar uma taxa de US$190 referente a esta categoria de visto.

Agendamento da entrevista: Após o envio do Formulário DS-160 o empregado deverá agendar uma entrevista na embaixada ou consulado americano mais próximo.

Documentação: Alguns documentos serão necessários e o empregado deverá organizar com atenção. Entre os documentos devem estar um passaporte válido, os formulários I-129 e I-797, o recibo do Formulário DS-160 e uma foto de acordo com os requisitos exigidos.

 

Entrevista no Consulado ou Embaixada: O objetivo principal da entrevista para o Visto H2A é verificar se as informações fornecidas anteriormente são verdadeiras. O entrevistador também pretende confirmar se o solicitante do visto pretende deixar os Estados Unidos após concluir o trabalho no país.

Tempo de processamento do Visto H2A

O tempo de processamento de um Visto H2A pode variar ao longo do ano. Normalmente, pode levar mais tempo no período que antecede a época de colheita, por exemplo. Já que muitos empregadores americanos estão na tentativa de contratação de trabalhadores estrangeiros.

 

O prazo para o envio da Petição ao USCIS é de no máximo 120 dias antes do empregador precisar trazer os funcionários estrangeiros para os Estados Unidos. A Petição não pode ser enviada antes desse prazo. O recomendado é que o processo de inscrição no programa de Visto H2A seja iniciado pelo menos 60 dias antes do empregador precisar do funcionário estrangeiro.

 

O titular do Visto H2A pode levar os dependentes para os Estados Unidos?

Os estrangeiros portadores do Visto H2A podem levar o cônjuge e os filhos solteiros menores de 21 anos de idade para os Estados Unidos.

 

Esses dependentes se qualificam para um Visto H4, que é o mesmo visto disponível para outros titulares de visto de trabalho H. Sendo assim, os dependentes poderão permanecer nos Estados Unidos junto com o titular durante todo o período do visto H2A.

Vale lembrar que os dependentes podem chegar aos EUA junto com o portador do visto H2A ou após a chegada do mesmo no país, porém nunca antes.

 

Duração do Visto H2A

O tempo de validade do Visto H2A é de no máximo um ano. No entanto, o estrangeiro pode fazer um pedido de extensão de visto em algumas situações, como por exemplo, se o trabalho ainda não foi concluído. Com a extensão de visto, a prorrogação será de um ano, podendo haver mais um pedido de extensão. Contudo, o tempo máximo de permanência nos EUA é de três anos para os titulares do Visto H2A. Ao final desse prazo de três anos, o estrangeiro deverá retornar ao país de origem e permanecer lá por menos três meses.
